The only statements I've seen are that Payton can't attend NFL games, have contact with Saints employees, or communicate with the team through a third-party. Brees is not an employee.

He can't have any contact with any NFL entity of any kind. He's even been warned not to attend college games as a fan unless he gives the NFL a heads up that he's doing it. He can't talk to Brees at all except to say congrats when his kid is born, and he'll have to report that call to the NFL as well.
