Agree with this^. HIMYM started well and faded severely. Scrubs got better and better (noone counts the med school season right)

Scrubs. This isn't up for debate. HIMYM is a riff on Friends. Deliberately so. Scrubs is its own beast. It is also cleverer and funnier, with better, more memorable characters and better, more memorable moments. Plus a top ten series finale versus HIMYM's bottom ten series finale.

Yes, HIMYM is a riff on Friends, one of the single best sitcoms ever. Frasier is a spinoff of Cheers, the actual best sitcom ever, and is also excellent.
At its peak, HIMYM is a funnier and better show, though Scrubs is also pretty great in its own right. HIMYM's main problem is that of consistency, especially once Jason Segal clearly lost interest in doing the show anymore. HIMYM is primarily peak value, while Scrubs was more consistent and able to adjust as the show's dynamics changed. Scrubs wins on career value, HIMYM on peak, so its really how you evaluate shows.

2. Better side characters like Dr. Cox, Janitor, and Bob Kelso
3. Better cutaway gags
4. Tighter story structure
So, in summation:
J.D.>Ted
Turk>Marshall
Elliot>Robin
Carla>Lily (not as funny, but a much better overall character)
The Todd>the cab driver
Dr. Cox/Bob Kelso together are at least equal to Neil Patrick Harris
Finally, Scrubs had a better ending.
