As long as you pay royalties or set up a rights agreement with the song owners you can play whatever you want.

You could do an Eagles concert every night, but you can't call yourself "The Eagles". That's where a lot of "formerly of" and cover bands get into trouble. Right now you have Jeff Lynne touring as "Jeff Lynne's ELO" because the name ELO has been diluted through former band members and cover bands being marketed as the Electric Light Orchestra instead of "formerly of" or branding themselves as a cover band.

Yeah, I get that anyone can pay royalties, but I was curious if former band members have rights to the songs without having to pay. Your ELO example might have answered that for me though.
