How’s that ridiculous? That’s the way it works IRL.

Re-escalating a de-escalated encounter shifts the defense burden.

And Robbie could possibly be tried as an adult depending on the judge given his previous issues.

It was a High School fight started by Miguel. Besides, Robby tried to break up the girl fight and got sucker punched by Miguel. All recorded by cell phones. A good lawyer gets him probation.

Remember though, Robby had Tory pinned up against the lockers by the time that Miguel showed up. Miguel thought Robby was attacking her. And as pointed out, Miguel was done and was backing off when Robby attacked him. Robby is the instigator at that point.

I'm really curious what happens to Robby, he should be in major trouble.

They'll both be expelled. Robby may have to do some Juvi time and/or probation.

ridiculous? It is a fact. He would be tried as an adult from his past run ins with the law.

And every kid in school had video of it on their cell phone. Attempted involuntary manslaughter AT LEAST.

And then one kid stopped fighting and the other kid threw him over a stairwell. All recorded by cell phones. That's definitely criminal.

No. There was no intent or premeditation. That will never make it out of the juvenile court system.

the situation was defused and he ignited it again. that is aggressive and would be tried as an adult. Are you the type that dies in a hole you dig?

Wrong. Besides, it's California. They protect juveniles more than any other state. Also, who's to say Miguel doesn't get charged with something?

Maybe in Cali - maybe.

If the people around them testify that the fight was over, and he still kicked him off the ledge?

That's attempted manslaugter most likely. Probably not attempted murder just because of the original fight breaking out, but the flip side is that these kids are almost 18 years old. They're all in high school and driving, etc. These aren't middle school kids.

He'd either be tried as an adult, or re-tried for the crime when he turns 18.

Perhaps they can do a deep dive on the ramifications on something like LegalEagle.

In Virginia he'd be tried as an adult. I don't know Cali law.

You're right that it isn't law and order. They aren't going to get into the legal mechanics of it all; Robbie will either be in jail or not.

Like I said, Robby could get Juvenile Detention or Probation. Miguel could also get probation and an expulsion for starting the fight.

I definitely liked Season 1 better for a few reasons...but the main reason...less spoken lines for Samantha LaRusso...her voice and accent are like fingernails on a chalkboard.
