I just don't care about the legal aspect of this. I am fine with him not getting convicted of anything. Having said that, he acted like a complete jackass

In other states, assault need not involve actual physical contact, and is defined as an attempt to commit a physical attack or as intentional acts that cause a person to feel afraid of impending violence. Under this second definition, verbal threats are usually not enough to constitute an assault. Some action, such as raising a fist or moving menacingly toward a victim, usually is required

Some states, such as Florida, now have “stand your ground” laws that no longer require someone being attacked to retreat if possible and allow the defendant to fight back if attacked; however, this usually requires that the aggressor’s actions be so threatening or violent that the defendant feared serious physical injury or even death if he did not fight back.

Hmmm.

Agreed. I see a video of a guy acting like a jackass. I see a video of a girl acting like a jackass. I see a video somehow of nobody else noticing or caring

Other than the bartender that looks like he belongs at splash, this is the weirdest part of the video. It's like no one around saw what happened.

It starts with them bumping each other. However, that is not out of the ordinary or illegal in anyway. The first illegal action was by the female. That was my point

Reading Florida statutes, is this what it's come to?

Here is the florida statute. What I posted is an example based on the interpretation by legal experts. The statute will not contain an example:

quote:

784.011 Assault.—
(1) An “assault” is an intentional, unlawful threat by word or act to do violence to the person of another, coupled with an apparent ability to do so, and doing some act which creates a well-founded fear in such other person that such violence is imminent.

It interested me when he said that simply raising a fist can be considered assault. I like to research things I don't know about.

Probably been said, but the chick he smoked is pretty hot. I find it kind of entertaining that the bro in overalls slinging drinks has no reaction whatsoever to the hysterical crying chick at his bar.

Because assault is the THREAT of violence.

"In common law, assault is the act of creating apprehension of an imminent harmful or offensive contact with a person. An assault is carried out by a threat of bodily harm coupled with an apparent, present ability to cause the harm."

Battery is the actual beating of arse.
