is the standard malice? that would seem hard to prove

if it's just tamper with (without permission) then that seems easy as hell to prove

didn't know there was a Ole Miss Rivals site. Well I could conjecture that there was, but unless I was really fricked up, I never made it over that way.

Riggggggggght. I remember all of your posts about how Orgeron was going to stick it to Miles and outlast him.

I can tell you right now that was not me.

It was a guy who had the same handle as you who proclaimed the same background as you, that you were from Louisiana and I think lived in Atlanta. It was you, no doubt. I would deny it too because alot of what you claimed didn't happen, especially when it came to the claim that Orgeron would outrecruit Miles and beat up on LSU.

Interference with contractual relations is a legit cause of action.

Exactly how did USC and Kiffin interfere? They are not under contract.

USC did not need permission. They did not agree to the contract.

quote:

The lawsuit accuses Southern California and Kiffin of violating Pola's contract that required him [Pola] to have written permission to discuss a job with anyone other than the Titans.

if anyone should be sued, it should be Pola. But that would not be good PR in the state of Tennessee

There is something called tortious interference with a contract: LINK

A simple google search could spare yourself and the rest of us your righteous indignation.

still won't likely hold up, especially the malicious interference.

Not sure how asking him to talk or offering a job is encouraging. But I guess it lies in the eye of the beholder. This wil be fun to see hwo it plays out either way.

Very important in all of this is if Pola told Kiffin/USC of the contract clause. This is a case where ignorance of the contract clause would hold up.

If the Vols get involved then there would certainly establish a pattern of this sort of behavior in Tennessee.

In the state of Tennessee, you cannot interfere with an established contract. What about this is so hard to understand? He did all this knowingly which makes it malicious. Oh, its hard to play ignorant when you have worked and broke these sort of contracts already.

I have no clue how the case will "hold up" b/c:

1) We don't know all the details.

2) I'm not arrogant enough to just look at a law and facts and think I know how substantial a case would be w/o looking at any jurisprudence on the matter.

I assume since you are confident enough to make those declarations (in bold-face type, no less) that you have a more detailed knowledge of the facts of the case and have researched the case law on the issue.

By getting him to leave his job with the titans and take a different job.

Damages are minimal but it exists.
