1) Urban is not a police officer.
2) Urban is not a marriage counselor.
3) Smith has never been convicted of any such crime, and has rights too.
4) OSU was clearly aware of the situation, so Urban's text mean diddly.
And why wasn't Ray Rice's coach suspended? We actually have video evidence there? Perhaps because in a sane world "itz not der yob, main"

To be fair, even in the case of Ezekial Elliot, they said they didn't have the manpower or resources to start recovering deleted texts. At least they are consistent.
