Fact is owners are already allowed to make a profit. If they think salaries are too high, don't give the players megacontracts. Let them walk in free agency.

i think the owners are putting up a good poker face as a collective group, honestly
there is a division in the ownership group, but the big market/rich owner teams are at bay right now. you can see their influence has already come to play with the concessions on the hard cap (which big teams will never go for)
the brilliance is that the owners have spun this into a negotiation tactic with the players to get public good will
but i think the owners anticipated the players would have broken, or will break soon...THEN they will try to negotiate for real. if this drags out and some of the big market guys don't get that revenue, i think you will see a split in the ownership

They can't do it because, guess what, the owners can't collude to not pay guaranteed contracts or not pay a particular player. Its illegal.
They have to collectively bargain. So...this is how they save themselves. Getting the players to accept as little in BRI and getting a hard cap is the only way they can do this.

i'm pretty sure the hard cap threat is off teh table and will never legitimately come back

I was more referring to the owner's position rather than the reality of what will happen.
I don't think there will be a "hard cap", but rather a very prohibitive lux tax at this point.

there is a significant difference between the federal law you have theorized and a union negotiated cba.
these things are not analagous imo.
if the nba, and all sports for that matter, looked for owners like cuban we would all be better off.
ie independently wealthy and ready/willing to take a loss on the year to win a championship. way too many clippers and royals owners out there.
that would be a pie in the sky scenario however
