Michael Buckner, an attorney who specializes in NCAA cases, told ESPN.com's Joe Schad that the findings in the Freeh report don't necessarily violate NCAA rules.

"It documented a lack of institutional control (as it is generally defined and understood) at Penn State, but not the lack of control as defined in the NCAA Manual or articulated by the Committee on Infractions," Buckner said. "Naturally, (NCAA president Mark) Emmert could disregard this fact and pursue an unchartered and unsupported course of action. However, I would let the legal system (criminal and civil) do its job."

Oh and Paterno is dead...and if he was all-powerful as some claim, so is the culture. Nobody punishes a nation after a dictator is deposed.

Also, have they talked to Todd Blackledge? I like him on the game broadcasts and think he's pretty level headed, so I'm wondering what his perspective is on this.

Basically what other sane people are sayong. It doesn't matter how much character he was said to possess, it's not ok to cover this up. Said if he had a son he would have to think hard about letting him go to Penn State because of the way the institution handled that situation.

Agree. This wasn't a football problem, it was a university problem. Saying the football program should get the DP doesn't make a lot of sense. Hell, just close the school if you really want to punish the entity responsible.

No the DP serves a purpose, just like the NCAA. The NCAA's purpose is not policing crimes; there are other avenues of recourse for crimes. There is no other recourse for recruiting violations. The NCAA has a set of rules, and when they feel that a program is abusing those rules and is not adhering to sanctions, then by all means kill the program. Blatantly and repeatedly cheating to gain a competitive like SMU did is completely different from what happened here. This crime is out of the NCAA's ballpark.


SMU was a repeat recruiting offender, and the program had to be shutdown to stop it. Shutting down PSU does what?

I don't think you understand the NCAA's jurisdiction...their authority and actions are prompted by violations prohibited in their manual/laws.

This is retarded. USC was on probation due to Reggie Bush years after he left. Did those players deserve it?
