I would hire your own agent. A listing agent represents the seller. Additionally, the commission has already been assigned to the contract with the agency.
Meaning, if a home is listed for 5% commission (intended for a 50/50 split), and the listing agent represents both parties, she will get the full commission, while having zero reason to work against the seller paying this huge amount of money.
Dual agency is legal in many markets, but the buyer is never ever going to get the same kind of loyalty that exists with the original client.
