Is an employee entitled to his vacation and sick leave when he or she decides to move on to greener pastures?

yes, I'm pretty sure it is a federal law.

What is the company policy? Therein lies the answer.

It's a matter of state law and typically how the policy is written. More often than not, you're entitled to accrued vacation time but not sick time.

^this. And the key word is ACCRUED. If your policy says your vacation/PTO time is ACCRUED, then by law it has to be paid out. Sick time does not have to be paid out if it is listed as a separate benefit from Vacation/PTO.

I feel like we have a thread about this here on a weekly basis lately.
Vacation - Payable
Sick - Not Payable
PTO - Not Payable (Unless it is specifically listed or recognized by your Employer that the PTO is partially or in whole recognized as vacation-related, then its payable)

The only way to answer this question is to know in which State (and possibly which City) you work and to know what your employer's written policy says (and possibly what the unwritten past practice and procedure has been).
