She is Alleging rape by her description. Someone having sex with an unconscious person who doesn’t want to have sex with them is 100% rape. Nothing that she alleges can be confused with giving consent.
Can it be proven beyond a reasonable doubt?? Probably not at this point. Your questions may come into play with proving the validity of what she is saying, but there is nothing hazy about what she alleges. She claims she was raped. If she is being truthful, it sounds like maybe she was drugged.

Miles had DGfor a season coming off the bench in 2015 and 3 games into the 2016.

DG supposedly raped 2 female students in 2016; however, no complaints/charges were filed by the victims.
