This is part of it.
If NOLA PD and DA allows this to go unpunished, then people will think it is the norm.

I don't think anybody has ever defended the guy, clearly his actions were wrong. But the fact he could spend multiple years in jail is a little absurd. This seems more like a probation/community service crime than anything. I don't really see how this guy is a danger to society. But, he was clearly wrong and will have to face the consequences, whatever they may be. Years in jail just doesn't seem to fit the crime.

Okay... so what we have here is an unconcious victim. Someone who is completely incapable of defending himself, and the lawyers for the defense are basically saying "since he was unconcious, then he didn't feel it... so... what's the big deal?"
Those of you who think this case shouldn't be prosecuted or should only be a slap on the wrist... is it open season now on people when they are at their most vulnerable?
What if the victim wasn't drunk? What if he had epilepsy or diabetes or something that made him pass out? Would it still be okay then?
To me, that's the reason why this guy NEEDS to be prosecuted. He looked at another human being who was completely incapable of fighting back, and he chose to sexually assault him. HE COULD HAVE JUST WALKED AWAY.

He did what he did because the victim was helpless.

No one said it was OK. Point doesn't compute.
