They removed the bullet, no plate was needed (praise God) the doctor was very pleased with everything he saw ... He put the feeding tube in and sewed him up! Time to start healing. They will take him off the ventilator tomorrow. If he does good , after that he will be moved to a regular room!
His family and friends really appreciate all the thoughts and prayers! They have been reading the thread and asked for this to be posted to get out some accurate info on his condition.

Probably way too early to think about this, but I wonder if he could plead down to involuntary manslaughter somehow. Sounds like a long short but maybe with the right lawyer

Why would a prosecutor offer him a plea that low. I definitely assuming he basically was pissed over a girl and shot him for that. I have no clue if there was a fight, self defense, etc..If he shot him in a way that could kil him (that's obvious now), then he would at least be charged for attempted 1st degree murder and there would be little if any plea offered without some sort of leverage in his defense.

It's just a crappy situation all around, obviously for Tahj but Brandon just pissed his entire life away in what seems like the heat of the moment.

Agreed, kinda....I have no details other than rumors and print news, but it is possible he did have time to retrieve a gun and go confront TJ wherever this happened...instead of it just being a spontaneous fight/shooting.
The DA won't sit on his hands for this one..if it is possible, they will put the heaviest charge on him that they can because of the heavy statewide coverage of LSU players.

If he didn't plan on doing it before he showed up, its not first degree. Wouldn't matter if he went to his car to get a gun.

I am not a criminal defense attorney, but from what I remember from crim law this no way gets bumped up from attempted manslaughter to attempted murder. Caveat: I am not familiar with LA law.

premeditated means to think out or plan beforehand. I doubt the time it took Winey to get his gun would define premeditated. It's more like a "crime of passion."

Winey was charged with attempted 2nd degree murder.
second degree murder n. a non-premeditated killing, resulting from an assault in which death of the victim was a distinct possibility. Second degree murder is different from First Degree Murder which is a premeditated, intentional killing, or results from a vicious crime such as arson, rape, or armed robbery. Exact distinctions on degree vary by state.

Winey could also very well plead down to aggravated 2nd degree battery with a deadly weapon, which carries a max 15 year sentence instead of facing life in prison. i'd be shocked, if at the very least, this wasn't ultimately a lesser included offense on the official indictment

This is what I was thinking with my post. I have no problems with the attempted 2nd degree murder charge but if you can avoid a trial and still put him away for a long time (sooner), then why not?
