Agreed, but the force needs to be proportional. Kicking a defenseless man in the head while lying on the ground in the fetal position....you would have a hard time arguing that the force was necessary to defend yourself.
Sensationalize much? Fetal position? Where was that in the statement?

I guess judges would be men of the bench? although I'm not sure I've heard that either

Regardless of anyone's beliefs, this is difficult case to prosecute. Someone kicking another person is not itself second degree battery. The prosecutor has to prove those things. I would suggest that a lot of pressure is being placed from both sides to prosecute someone or drop the charges. I am somewhat surprised how the police have handled this relatively minor event. There have been too many leaks and statements to the press, to the point that the investigation has itself turned into a circus.
Remember, the burden is on the prosecution. Conflicting statements make it hard to prove a case beyond a reasonable doubt.
Finally, how is the world do the police "know" that a statement given by a witness is not true. Just because something seems to contradict that claim, it doesn't mean the story is untrue, but that perhaps it is only a part of the truth.
Don't rush to judgment on this.

As such I can only conclude his improper use of third party in the OP was intentional and misleading.

I'm not, on either side.
Like most things the truth usually lies between both sides...somewhere in the middle and there is usually guilt on all sides.

quote:Such a bland statement. Possibly about 90% of the people want this, of course. If you don't have anything to say that's more substantial than that, quit posting so much. It sounds like you have an agenda because of your constant posting. If you want the police to investigate it and find the truth, then just sit back and shut up and let them finish what they are doing.

I want him to be punished, IF he committed the act. That's why the polcie are investigating, to determine these things.

CptBengal: there is video of the kick. It actually occurred. that is not in dispute.
What's in dispute is everything before that video. How many times did the guy hit the ground and pop back up for more before that video was taken? How did it all start? We don't know. If he had been fighting back after hitting the ground then it wouldn't be surprising if someone kicked him to keep him down.
We have one story from Shady4 + a third party that seems to have been with them that night, and we have a statement from a bar employee. The 5-0 have the footballer's story, and they don't seem to have enough on anyone in particular yet to press charges.
I think many on the board believe you have it out for JJ because you frame everything with Shady4 as victims (defenseless guy kicked in face, 3 fractured vertebrae, etc.) while it isn't clear how any of this actually went down (besides 22 seconds of useless video in which no one can reasonably be identified and testimony from one observer who seems connected to the alleged victims). I'm sure that if things went down as the police report said then most on this board would want "whoever broke 3 vertebrae of the victims" to get their comeuppance. But we don't know the circumstances, man.
Anyway, quit being a douche.

there is NO justification for this unless the man had a gun in his hand. What is so hard to understand about this???
