The NCAA supposedly created rules whose actual words did not exclude the Class of 2022 in the way the NCAA claimed, knew from its own rulemaking and testimony how that language operated, but nevertheless continued representing to courts that the athletes were excluded—while spending heavily to fight those athletes and arguing that letting them play would cause the NCAA irreparable harm.

If that characterization of the evidence is ultimately proven, the troubling part isn't Five-for-Five itself.... It's what the NCAA knew versus what it represented to judges.

And that's why the lawyers keep returning to the courthouse. They're essentially saying: Forget NCAA press releases, public opinion, money and institutional power. Put the written rule in front of a judge and answer one question:

“Show us the words that exclude the Class of 2022.”

Their entire scandal allegation rests on the claim that the NCAA can't.
