This whole saga is bewildering. Considering a) there is no record (that I'm aware of) that TM was ever suspended for a year and b) there is nothing in the LSU Substance Abuse Policy that mandates permanent ineligibility after a third violation, my best speculation is that there is internal dissension in the LSU Admin. Somebody really wants TM done at LSU and someone else is willing to go along with the policy. Just pure, unmitigated speculation on my part.
For my part, really, really wished TM would get his act together and finish his CFB career in P&G.

My coworker is leaving tomorrow to go play football for Nichols. I'm sure if TM7 has decided to play for them he would know. I'll definitely ask him tomorrow.

Only thing I can think of is that an appeal of the third one was done by the head coach. Also speculation on my part.

I admit I'm not conversant in the policy (see especially on pp. 8-9) - you may be right. As I understand it, rule #11 would come into play after a 3rd violation, an appeal from Les which got approval from the Administrative Voting Committee, and a subsequent violation.
In TM's case, this measn we are no longer facing a year's suspension due to a 3rd violation but a "post-3rd violation appeal violation."
OK - I give up. Hope he gets to come back.

Appeal? Are you kidding with this. What evidence if even just insider rumor mill is that there is or was any type of appeal?
It seems pretty obvious what happened imho. TM failed his drug test for the second time and was punished for it to the minimium allowable punishment.
Now he failed another and rules dictate a mandatory 1 year suspension from playing in any football games among other penalties that we aren't interested in.
Les Miles and admin had a meeting and TM decided to take his talents elsewhere. Maybe (pure speculation) he got a bit... mouthy.
Now it hits home and he realizes what he faces. Swallows his pride and returns to see if LSU will take him back, which is what was probably offered initially.
Now administration doesn't want him back and wants to wash their hands of his attitude and disrespect.
Les Miles wants him back but right now emotions are to high for someone in administration to OK it.
The ban for a year is required by LSU rules which LSU can't violate or sanctions for violating them would be enforced by NCAA.
The permanent ban is a decision not required by LSU rules at this point. It was imposed by someone higher than LM if it has been imposed at all.... we don't really know despite people saying they do.
If it is a permanent ban all that has to happen is for whoever decided that to change their mind. Maybe time will heal some of their wounds. If the answer had to come today then TM would probably be history. If TM sticks around and does all the right things then maybe the hate will wear off and admin will succumb to others to let TM return.
That is what I think is probably going on. Unlike all the a-hole reporters that have their thoughts but I am not passing mine off as fact like they are.
These thoughts are based on facts, direct quotes and the rules.
All talk of 4th, 5th etc drug violations are based on NOTHING and are actually contradicted by some of the evidence.

I don't think there is a permanent ban. While it's pure speculation on my part, the lack of a having a new chancellor in place is the most probable cause of what we are seeing. The interim guy (I don't even know who he is so I don't know if this makes sense) will not want to make and place a possible shitstorm decision at the door of his future boss. The BOS will not want to present the perception that the AD is running the show in the wake of Penn State while conducting a search. The family probably wants assurances and Miles can't give it at this time due to this uncertainty.

Is what permanent? It's a Clinton like what is the meaning of what, but it's important to know what question Miles was really answering and only he knows. Privacy laws create some really awkward conversations. The most direct way to present this would be to hand out the policy and say this is where we are, but you can't do that.
At that point Miles could have sincerely believed that TM wanted to transfer and had no interest in remaining. So the what Miles could have been answering is TM gone permanently and from his perspective that would be true. To point out the options in policy at that point would be saying what the issue was and he can't do that.
If this is the case, could he have chosen his words more carefully? Yes, but this isn't an everyday occurrence and mistakes of this sort are easily made and only people with agendas get hung up on them.
