Wouldn't the hate crime fall onto Hill's shoulders? Also I didn't see video of altercation, but even if someone calls you a racial name, does it give you carte blanche to wail on them. No is the correct answer.
Race Card is overplayed so much these days it cheapens the efforts of those that actually fought for their civil rights.

This isn't a civil case. The DA can press charges with or without consent from the victim
That's like if you shoot your dad in the head and he survives and says "no, don't press charges, my son is a good kid"
