Correct, the only thing confirmed is what the BRPD said. I don't listen to every person who says he knows so and so who was there(blackout drunk no doubt.

The "victim" incited the fight by dropping the n-bomb

And there is no mention of this in the police report.

Victim could easily be charged with public intoxication, so that won't help his case either

So no punch was thrown after the "victim" dropped the n word? The reason I ask is because the crew on Sports Today said that the "victim" had done this.

It's the same guy that kicked the douchy Marine in the head at Shady's.

That dude gets around, I tell ya.

you are allowed to call people the n-word.

It is legal...it is not grounds for an inciting charge...so sorry.

I don't think so.

Because think about it, how do you charge the other person and not the victim when they:

walk out in the parking lot, say get out of my way n---- and then when the group responds essentially WTF did you say to me, followed by, you heard me n-----, then throws the first punch on top of that?

If that were the case, I don't think this would be an issue at all because all the fault would be on the "victim" not Hill

Following your example then yes Hill was not at fault based on the events that played out. However, if "victim" did not throw the first punch and it was in fact JHill then he's got some charges coming.

Now we are diving into a whole new angle to this situation.

It all depends on when the witnesses saw what was going on. I was under the impression that this entire incident started in the bar and quickly escalated to the parking lot.

It's baffling to me how someone can completely instigate a fight, get there arse kicked, and because of that, theyre a "victim".

Legally, mere words are not regarded as adequate provokation for battery. The law doesn't countenance human beings inflicting physical harm on one another because of verbal insults.

Practically, charges are rarely brought in the situation you describe (unless there is severe bodily injury or some other aggravating circumstances).

That doesn't mean the legal system and those involved won't have sympathy for him though
