No summary judgment because there would never be a scenario where material facts weren't in dispute.
I'll read it today. At this point it's probably best for Victorian to cut his losses. There's no point in even spending the filing fees on this. He's (likely) not playing Division 1 baseball regardless, and MLB scouts wouldn't care that about some rescinded expulsion based on a due process technicality. Maybe his attorney is angling for a position with his team down the road?

He and his parents are good people.
Unless you were there and know them personally, you should keep your mouth shut.

After reading his petition, it seems like even if they overturn the original decision to expel him, the school board can pretty easily just reaffirm that decision themselves. Seems like waste of time and money on Victorian's part.
Just searching his name, looks like the poor kid just got sued for an unrelated auto accident also

just having a knife on campus is immediate grounds for suspension/expulsion and actually brandishing it means you are done.
I know a kid that got suspended for putting a regular table knife in a pumpkin decorating contest like the pumpkin was being stabbed and the school cop recommended suspension and even considered expulsion in that one incident.
