You are 100% correct. High school kids in texas can not participate in NIL according to recent legislation that was passed. I knew what school he attended. Was just pointing out he is from Texas, not Ohio. Didn't think he would know the school, just correcting him on the state.


I think the Texas law does not allow Universities to use the brand and trademarks of the University. So my guess is SMU, TCU, Baylor, Texas Tech, Houston alums in the Texas Legislature probably aligned to put that in the Bill.

LA's NIL law allows Universities the decision on that question and LSU has already told its athletes that they can Use LSU logos, brands, etc.

Taxes are going to get a lot of these kids in trouble. I hope coach O is getting a tax expert set up to assist the players.

Yeah, they have someone to deal with all that but you know there will still be problems when that time comes.

Thanks man, I know we will all get this straight eventually, but talk to 1 person get his answer, next guy, totally different explanation. But again Thanks you are 1 st lawyer to verify

Since you are hear, any truth to Texas Schools kinda behind 8 ball from some existing laws on their books. Totally understand if your not familiar, again getting different answers, but don’t think any by actual lawyer?

I’m not overly familiar with it, but will get you a general answer.

ETA all below:
Texas passed its own NIL statutes that are significantly more restrictive than NCAA NIL rules. These differences are:
1) tx athletes have transparency requirement meaning they must disclose to their school any proposed contract related to NIL
2) athletes barred from signing deal which conflicts with schools (principles and values); calls for compensation while athletes engaged in official team activities; and draws in intellectual property owned by school (logos or trademarks)
3) there are certain NIL deals that are expressly outlawed (alcohol or tobacco, anabolic steroids, sports betting, sexually oriented, etc.)
4) any portrayal or label that constitutes pay for play is outlawed.

ETA (2):
Texas allows the institutions to adapt its own nil laws which can be more restrictive but not conflicting. So schools like Baylor, sponsored by Nike, could ban an athlete from promoting another athletic brand.
