The facts really don't matter that much to prosecute if it fits in the statute. It is a question about what is the age and did the contact take place.
That being said the facts are totally different in the two scenarios which would greatly affect the sentencing phase. The guy in the first scenario would obviously get a lighter sentence than the guy in the second scenario if found guilty.
But the DA has to decide to prosecute and girl and her parents have to be willing to put her through a trial. Don't be surprised if once the emotion wears off they get cold feet about putting the girl through all of that and a plea agreement of some type is reached.
This is not really the type of attention families want and 14 yo girls need.
