So we built our house in May 2019 and our builder warranty just expired. But 2 days ago we found water under our floors in middle of living room, I have also noticed after a good rain, my driveway seeps water out from it through cracks. I have leak detection coming to see if we have a plumbing leak, but if one is not located and is not the source and it does turn out to be foundation issues with water pushing through, should the builder still be responsible for this issue? Should a lawyer get involved?

If your 5 year new home warranty has expired, your builder is off the hook generally.

I hate to say this, but the new home warranty covers a lot less than people think. The warranty starts on the day you bought the house from the contractor or occupied it.

Plumbing issues are no longer covered after two years. The only thing covered more than two years is a "Major Structural Defect"

The law isn't consumer-friendly. It does more to protect the contractor than it does to protect the homeowner.

LINK

quote:

(5) "Major structural defect" means any actual physical damage to the following designated load-bearing portions of a home caused by failure of the load-bearing portions which affects their load-bearing functions to the extent the home becomes unsafe, unsanitary, or is otherwise unlivable:
(a) Foundation systems and footings.
(b) Beams.
(c) Girders.
(d) Lintels.
(e) Columns.
(f) Walls and partitions.
(g) Floor systems.
(h) Roof framing systems.

quote:

(3) Five years following the warranty commencement date, the home will be free from major structural defects due to noncompliance with the building standards or due to other defects in materials or workmanship not regulated by building standards.

I had something similar in my dining room. It was my dishwasher leaking in the island and water traveling under the flooring in the kitchen to the dining area. Very few houses build these days have water supply lines in the slab. It's usually run in the attic. Is there any chance you have an appliance leaking somewhere near the living room?

Concrete cracks. Water finds any way possible to get in and out of weird spaces.

I know this is days old…..but it does not take a plumbing company to do this. With all water shutt off in the house, just go and look at the meter. If the hands are moving when there’s no water running, you have a leak.
