quote:

This lawsuit, which was filed in the Tokyo District Court, seeks an injunction against infringement and compensation for damages “on the grounds that Palworld, a game developed and released by the Defendant, infringes multiple patent rights.”

“Nintendo will continue to take necessary actions against any infringement of its intellectual property rights, including the Nintendo brand itself, to protect the intellectual properties it has worked hard to establish over the years,” it said in a statement.

Although the gameplay of Palworld is vastly different from Nintendo’s series, debate swelled around the perceived influence its character designs have taken from Pokémon, and whether it could be interpreted as plagiarism.

There were even some accusations that Palworld’s 3D models were nearly identical to those found in Pokémon games, with two experienced AAA game artists telling VGC that, if this was indeed the case, it would likely indicate that Palworld’s character models were based on Pokémon assets.

Just surprised it took them this long.

Paco Gutierrez, age 9, always wanted a Nintendo console. However, due to being extremely poor living in Venezuela, it was just a distant dream. Using his creativity and with the help from his uncle, he made a cardboard Super Mario game, posted it on YouTube and the video went viral. Thanks to the video, Nintendo's CEO Doug Bowser personally traveled to Venezuela, to give Paco a Cease and Desist order and sue his family for 200 million dollars.

There was another Pokemon-adjacent lawsuit filed against a Chinese developer that came up in my newsfeed yesterday. Seems like they've been super busy on that front.

Florian Mueller, the expert who predicted exactly how the Microsoft ABK court cases would end up because there was never a monopoly threat that could be shown, says this case will go nowhere for Nintendo. He doesn't think it will be settled though and will probably take about 5 years to reach completion. He says it could result in an injunction in Japan only, but that would require Japanese courts to misinterpret Japanese law. He also stated that Nintendo has no such argument in any other jurisdiction in any other country. That is likely why it took Nintendo so long to file anything, and only in Japan. They don't really have a case and they know it.
