My biggest question about this whole issue is does the entire 3% surcharge go towards employee benefits? If the restaurant is collecting for that specific purpose it better be 100% going towards employee benefits and not in their pockets. Is the restaurant opening themselves up to a law suit?

The business is paying. Unless they are list billing you personally for the restaurants employees benefits.
Here is something that will blow your mind. Everytime you buy a product or patronize a business that offers benefits to their employees you are chipping in to help pay for said benefits. At least this restaurant gives you the option to not chip in. So if you eat at this restaurant and your bill is $25.00 you can keep that 75 cents and apply it to your own benefits.

Your not making sense. It's optional. That means you have the choice not to pay the surcharge. In a sense they are doing what you are suggesting.

They are going to put it on the bill whether you ask for it or not. Making the customer now have to ask for it to be removed. That is not the same as simply making it a menu item. And like I said, how many people would order a side of insurance with their meal? I bet that number would be a lot smaller than what they are getting now. The restaurant is guilting people into ordering the insurance.
Maybe I'm just not explaining it right.

I would be more afraid if I was the business that an employee would accuse me of not using the surcharge for their benefits and try and sue me. Which probably will happen to this business eventually. A lot of restaurants don't offer benefits and the servers and or their children end up on medicaid. If this prevents medicaid rolls from growing I am all for it.

I like this idea, because that gives me the opportunity to subtract that amount from what I would otherwise be tipping.

Agreed, because then you would know going into the meal of the final cost.
It's not like it's a large amount anyways, but it is forcing the customer to pay the surcharge or tell the waiter that they aren't interested in paying their insurance. And you don't frick with the people that bring you your food. Like I said, I'd pay it the first time, then likely not go back.
I'm actually surprised only 3% would be enough to cover these benefits. If the government charged a additional 3% sales tax to pay for insurance for all, I bet more people would be for it. Be a lot cheaper than what I'm paying now. I still would not be in favor of it though.

It might but it more than likely doesn't. It would depend on the volume.
