You would have to use caution in states where water rights are important.

There are more efficient ways to make hydro systems that don't utilize a dam and gets around the water rights issue.

Most common is to divert part of the flow and gradually decrease the size of the pipe, then utilize the resulting high pressure flow to run a pelton wheel.

Water rights aren't an issue because the water is returned back to the main stream without any blockage.

Out west water rights are life but I wonder how they would rule on this since they aren’t “using” the water.
