But if he lives, there is the pesky element of having to use the monetary awards to actually pay for his 24/7 care as intended. If he dies, no responsibility besides a funeral, more time for vacations

Exactly. If he lives any money she gets is his money and has to be accounted for and used for him. If he dies she gets all the money to do what she wants with it
