I don't understand this. There is zero chance a 2m judgment would even be upheld at 5th.

Which is why half of the council is hellbent on pushing through these settlements hoping that the other half will negotiate down and accept one of them.

Make no mistake: these council members are not representing the city in any way. They are directly representing that family (and most likely their kickbacks) to your detriment.

Well they suck at negotiation. You don't just double it every time someone says no.

Okay, let's offer 2.5 mil to the family - oh, they turned it down.

Okay, let's pass a resolution for a 5 mil settlement - missed it by one vote

Okay, let's try for a 10 mil settlement - TBD.

At the same time, the parish attorneys are trying to move the case to another parish and asking for clarification on whether damages are capped at 1 million dollars.

On Monday, Judge William Morvant of the 19th Judicial District Court rejected a change of venue request filed by lawyers representing the city of Baton Rouge, who argued that the local jury pool had been poisoned by media coverage and recent protests over police brutality.

Morvant said he'd entertain a request to move the trial if, during jury selection, it becomes clear that they're unable to find citizens who haven't already formed an opinion on the case.

Morvant also rejected Monday a separate request from parish attorneys to clarify whether there will be caps on payouts if a jury decides the city is liable for state tort claims lodged against them. They argued that statutes limit the maximum payout to $1 million, but Morvant said the question was premature and will be addressed if necessary after the trial.
