pretty sure that would be no since roberts, as chief justice, is the one who decides what cases they will or wont hear and when

No, it takes an agreement of four justices to hear a case.

However, this wouldn't be a new case but a motion on an existing case, so ACB wouldn't be involved since she wasn't seated for oral arguments.
