Did she not produce copies? I thought the issue was that the LDR could not prove she turned them in.
I thought her CPA produced the copies. But a copy doesn't necessarily prove they got filed.
It's a dumb reason to stop someone from running, but I think that is the issue (not sure though).
If she produced copies then that’s different. If that’s the case I apologize.

The court’s logic in previous cases, as pointed out in the dissent, is that they aren’t supposed to be DQing candidates unnecessarily.
If it is reasonable to assume she filed, she should be considered eligible. And the fact that she has filed multiple other years in the same timeframe while LDR has a history of losing returns tells me she likely filed it and they lost it. ESPECIALLY if paper copies were involved.
As pointed out in the court filing, she claims to have filed the 2015 and 2016 returns in the same envelope and received a refund for 2015. If those returns weren’t batched correctly by the mail room, they may decide that the second return is an attachment and not an actual return.
