Just because the police refuse to act against something does not make it legal.

If a cop searches your vehicle and finds a few stems/seeds he may not want the hassle of writing it up and ignore it. Doesn't make it legal to be in possession though.

If a cop stops you 2 driveways from your own for DUI and you are drunk, he may let you go on to bed. Doesn't make you any less drunk.
