Not necessarily if they have witness statements that hold up the story that he also helped chase Arbury around the neighborhood and that he blocked him in to force him towards the McMichael’s truck. That makes him an accomplice at that point.
ETA: Have to remember we only got a 30 video of a pursuit that occurred for a few minutes unrecorded.

So what if he helped try to round the guy up. Whose to say that he knew Bubba was going to be holding a shotgun at the other end of the street?
