If the business owner is located in a marital property state that recognizes personal and entity goodwill issues, as is the case in most non-community property states, he should argue the business value is primarily personal goodwill, which is not a marital asset and is thus not subject to division.

If I were a scheming individual, and was starting a business or even after getting it going, maybe pose the scenario to my future ex-wife that I would like to insulate her from all liabilities of this treacherous venture by writing her out of all liabilities and gains.

Does this have any legal validity? No clue!

Or just divorce before the biz becomes successful!

An often overlooked part of a business operating agreement should include spousal agreements. Without it, you are screwed.
