The problem, though, is that for every “Bob” who is legitimately injured, there are 10 “Bobs” who aren’t. But they know that if they go get the right plaintiff attorney and go to the Dr who the plaintiff attorney “recommends”, then that Dr will say “oh yeah, he’s got some soft tissue injuries. Needs physical therapy. Maybe a chiropractor.”
So uninjured Bob decides that even though it’s kind of a pain to go to physical therapy and chiropractic treatment, he’ll do it because his lawyer tells him it will be worth his while. Of course the physical therapist and chiropractor will say he must be hurt- his flexibility is limited, he complains of pain, this sort of accident “could certainly cause these types of symptoms” and according to Bob, he “wasn’t havin this pain before the accident.” He starts off going 2 or 3 times a week, but then doesn’t want to deal with it as much. So he reduces his visits to once a week - enough to still be considered “treating.”
Finally, after 9-12 months, Mr Plaintiff Attorney demands $45,000. Why? Because he’ll stipulate that his clients damages are less than 50K to ensure that the Judge, whose campaign he generously contributes to, will hear the case, rather than a jury that might smell the B.S.
Attorney has now made his 15K for doing virtually nothing and uninjured Bob now has 30K for just a few trips across town, which is likely more than he makes in a year.
See how great the system is???
