I am guessing you didn't see the part where Fredo threatened the kid. He said he would throw him down the stairs. He then continued yapping. The kid said "what are you going to do about it?" This is, and has always been an invitation. Saying "No, you would just sue me" is backing down.
So, he threatened physical violence, was told to step up and get some, then backed down. The fact that Fredo kept yapping doesn't negate his backing down. Maybe you and I didn't see the same video. I watched the one in the OP.

Failing to step up is not backing down. Backing down implies he stops what he's doing. So yes, the fact that Fredo kept yapping does mean he didn't back down. There was no change to what he was doing.
I swear, this place is the only place that will make you defend someone as dumb as Chris Cuomo.
