He had full discretion to make that call. It simply makes sense to investigate and indict where he believed crimes existed, of any existed, and let the Judiciary deal with the question of constitutionality, as it's supposed to work.

Also, Mueller hopefully understood the relevance of the situations in 73 and 00....73 you had Nixon's (head on the line) own DOJ opining that the President not be indicted, same situation in 00 with Clinton's (head on the line) own DOJ. The obvious intent of the opinion of protecting those Presidents on a partisan basis should have been clear to Mueller and persuaded him to let it be settled in the court system once and for all.

That he backed off of that option convinces me that he ultimately had no good cases against Trump to put into play. So he did the next best thing....the rest is history.

If the Public Utility meter reader comes out to your house and sits and stares at the electricity meter for two years and then goes back to his boss and says he can't determine if you used any electricity at all....then you probably didn't use any electricity and therefore you have no bill to pay.

Democrats: You meant to say it is because of the OLC opinion
