What exactly are the ideals of respect and tolerance embodied in the First Amendment? Sounds like the gobbledygook used by "activist" judges when the law doesn't fit their political leaning.

Look the Memorial Cross clearly passes the Lemon test no ifs, ands, or buts, it's done. I'm personally an accommodationist when it comes to the Establishment Clause, can't show preference for a religious institution over another but can promote religion in and of itself through accommodations for symbols, vouchers, and things of that nature. Accommodationism actually constitutes a very originalist and textualist interpretation of the 1st Amendment as it historically reflects the Founders' intent in drafting the Bill of Rights. It makes sense, the point was to prevent the federal govt from establishing a state religion, that's really the core of it but doesn't preclude them from accommodating religious individuals and entities in promoting religion as a whole. It is what it is.
