You don’t need someone’s consent if they are in public
Section 107.39 Operation over human beings.
No person may operate a small unmanned aircraft over a human being unless that human being is:
(a) Directly participating in the operation of the small unmanned aircraft; or
(b) Located under a covered structure or inside a stationary vehicle that can provide reasonable protection from a falling small unmanned aircraft.

Actually what i referenced is if you fly under Part 107. I just started looking up flying under part 101, and i dont see anything about flying over public. Which is odd. But these rules are amended rather frequently.
it does state this:
(b) The aircraft is operated in accordance with a community-based set of safety guidelines and within the programming of a nationwide community-based organization;
Which these safely guidelines usually say follow 107. noone is gonna come after him for flying in this situation, i hate and wish would get a ticket are the tards that fly over parades near and around power lines and light poles and such. i see that negligence too often.

How did the Chick Fil A fare?
No real damage.
Just closed because of powerlines being down.
Courtyard and Chick-fil-A were extremely lucky, considering how close that Hibbett shopping is

Where does the statue you posted say anything about consent?

Are those privacy concerns or safety concerns?
Define "over". The drone isn't recording video straight down.
Not being a smart aleck. Asking.

safely. here is the FAA link of flying under part 101, the bold would constitute breaking of the rules flying over people.
LINK
Review the Rules
It is important to review the rules for flying your drone, prior to your first flight.
Fly only for fun or recreation
Follow the safety guidelines of a model aircraft community-based organization
Fly at or below 400 feet when in uncontrolled airspace (Class G)
Fly within visual line-of-sight, meaning you as the drone operator use your own eyes and needed contacts or glasses (without binoculars), to ensure you can see your drone at all times.
Never fly near other aircraft.
Never fly over groups of people, public events, or stadiums full of people.
Never fly near or over emergency response efforts.

You are citing federal code. Who in Ruston has the authority to “write a ticket”? You aren’t really an officer are you? No wonder so many cases get thrown out.

Who the frick cares if there’s some law about it, he’s documenting a major disaster in the area that got the word out on what Ruston's dealing with. His drone video is being shared all over Facebook around here which is a good thing.
