There is no singular popular vote. There are 50 popular votes. How can you award a candidate electoral votes for a vote that does not exist? The federal govt does not sanction a national popular vote. How would this even be defended in court? These states can all argue that they have a right to award their electoral votes to the winner of the popular vote, but the govt is going to counter with the fact that a popular vote doesn’t exist. It’s merely the sum total of each state’s individual elections.
