As stated, there may be an issue with using defense funds for a civilian construction project. But otherwise, I agree with you that the Supreme Court will likely tell Congress, "You gave him this power, its up to you to take it back."

So el chapo and Mexico are paying for the wall? Drugs come from Mexico. We confiscate property and sell the goods and then build a wall with the funds. Nice.
