As stated, there may be an issue with using defense funds for a civilian construction project. But otherwise, I agree with you that the Supreme Court will likely tell Congress, "You gave him this power, its up to you to take it back."

Oh and NO ONE has ever been convicted or indicted for its violation (Antideficiency Act). It's like blue headlights, yeah it's a law, but...
