I don't believe that was my premise.

One can concede that gender and sex are different while not conceding that gender should make a bit of difference. For example, one can easily hold the position that it doesn't matter what one's gender identity might be, we should have binary bathrooms based on sex. To go to the other end of the spectrum, one could argue that because gender is a continuum, we shouldn't have any communal bathrooms at all, and all should be private.

Further, one can can functionally have the exact same argument by saying that they don't concede that sex and gender are different, but if we simply ignore the terms for the sake of argument, it doesn't matter (insert argument above, but transpose "cultural behavior" for "gender", or whatever).
