Question for the board regarding illegals who commit crime:

This question came to reading about the illegal immigrant in Atlanta that killed her family.
If an illegal immigrant commits a crime in America what should we do with them?
Deport them to wherever they came from or punish them here for their crimes using tax payer dollars?
Does your answer change based on whether the victim was a citizen or other illegal?
Does the severity of the crime change your stance at all?

Depends on the severity...unless we can be certain that the scumbag will be incarcerated if returned to his home country. Can't just deport him and risk him sneaking back in to commit more mayhem if he's a violent criminal.

Nearly all countries won't recognize a penal judgment from another jurisdictions. Mainly because they did not have jurisdiction over the crime. The U.S. can't prosecute someone for crimes committed in Canada, and this follows that we can't also punish someone for crimes committed there.
So they'll go back to where they came from if we send them, but they're not going to punished there.

I generally think deport too, but my answer changes if it's a crime of violence and against an U.S. Citizen. I'd be pissed if an illegal harmed my family and his punishment was being sent back to where he came from to live as a free person.

Ok, but it is literally impossible to implement that. Even if we wanted to. Again, when discussing possible methods of handling something, I tend to only consider things which are possible solutions.

I'm not an attorney, but this guy is, and he says otherwise.
"Q: If an American is convicted of a crime in a foreign country, can he or she serve the sentence in an American prison?
A: The U.S. has entered into prisoner transfer treaties with many nations that allow a person convicted of a crime to be transferred to his or her home country to serve the prison sentence. A prisoner who wants to be transferred should notify the U.S. embassy or consulate of his or her desire. The application then must be approved by the foreign country and the U.S. Department of Justice before the transfer can take place. A prisoner who is transferred to the U.S. will have his or her sentence reevaluated, and may be resentenced according to U.S. law."
And Mexico is one of those countries.

That's only if both countries agree to. Obviously that treaty mentioned (one I was not aware of) is an example of an agreement. There certainly is not mandate that a country has to. I'm not going to say for sure, but I sincerely doubt that we have a similar treaty with ME countries. I practice state criminal law though. By no means an expert on international law. I just vaguely remember having to learn a little of this shite for the bar.
