So, you're considering consulting with an attorney because you may have aggravated a previously documented condition that you very recently had treated with multiple injections?

Eggshell plaintiff rule.

I'm still not your lawyer, OP.

Dude, it was a bench swing like the kind your MawMaw has on her front porch.

You're fat enough to break one of THOSE?

I also don't think this thread is going quite like you'd hoped.

So what good will it do to file suit? Would want someone jackass doing that to you over a accident?

Sounds like you shouldn't have been fricking around on a swing in the first place.

Why should the property owner be responsible for your fat arse breaking their swing?

Especially when OP knew of his back problems and didn't check the swing.

Premises liability cases have to be severe to garner any real sympathy

Btw, I'm not your lawyer.

Do we even know where the injury happened? OT, why should a person not pay for damage caused by their thing?

I'm not your lawyer either.

So you already had a bunch of back problems but you're going to sue someone for your existing back problems?

About what? Assumption of risk? Good luck in Alabama with those facts. You were on notice of health issues, regardless of open or hidden defects in a Swing.... Nuts

ETA:turn in your man card and your bama fan license. Your AU crying towel is in the mail.

We went because my physician said it would be fine as long as I wasn't doing anything strenuous. I'm not sure I consider watching the sunset from a damn porch swing strenuous.

Gotcha...I was meaning travel in general.

Sitting in a car or plane for a long period of time...that cannot feel good when you have back issues.

It sucks what happened...but sounds like it was an accident.

You should see a personal injury lawyer and you have a great case. You don't know how this will effect your back moving forward. Do it this week. I am a lawyer but you need one who specializes in personal injury.

Posters that are acting like I did something wrong need to learn reading comprehension.

My Drs orders were nothing for the first 24 hours. I did that. The orders after that was nothing strenuous for the first week. The most strenuous thing I had planned to do was toss a Cornhole bag and lift a beer out of the cooler.

My teenage boys wouldn't even let let unload the truck.

So your clumsy arse fell off a swing and irritated your already gimped up back? And you want to sue? What a pussy.

At least you are already on disability so you won't lose any on that monthly check from them government
