As nice of a 'one weird trick' this is for Lion Ted Cruz, this is exactly the kind of thing that shouldn't get dug up, because in 8 years, the DNC will be doing the same thing when the pendulum swings back.

I'm pretty sure this is what happened when Obamacare was initially passed. Joe Biden ruled that it was valid under reconciliation. I may be misremembering though.

Apparently the Dems were ready to use this rule in 2010 to pass Obamacare... Feb. 2010 Red State article

frick it. Time for the GOP to grow a pair if we are ever to get our agenda through. I'm tired of playing nice...all that's gotten us is a steady trickle toward big Govt and leftist policy.
Do it, and hope it creates enough positive change where it becomes politically toxic for Dems to mess with it

This is the kind of thinking that the GOP can't have. The dems have already proven that they can and will use these type of tactics when they are in power. Heck, the dems were ready to use this rule back when obamacare was first pushed through, and let's not for get that it was Reid that implemented the nuclear option. So the GOP can't worry about what the dems will do once they get into office, because they have proven that they will do it regardless. So why should the GOP handcuff themselves when the dems aren't?
