They both have intrinsic value, but they both also are born with free will. Well, unfortunately the unborn baby isn't but theoretically he/she has it. A person can be deemed so harmful and dangerous to civil society that they cannot be allowed to live. And whether we like it or not, the death penalty also serves as vengeance for the victims and their loved ones. And for those who look at it from the religious angle, there isn't a prohibition in the Bible that the State cannot take a life through its own mechanisms.

The focus of our criminal justice system should not be vengeance. It should be rehabilitation. Killing someone doesn't bring anyone else back to life. I totally understand why someone would want to hurt someone who has hurt them, but I respectfully disagree with that approach to justice.

Jesus said that we should worship the heavenly Father before earthly kings. "Thou shalt not kill" is one of the 10 commandments. I don't see how you can argue that the Bible doesn't take a stance on the death penalty.
