We're forgetting something here. A very key piece of information.

If she listened to the cop the first time, she wouldn't have a battery charge.

Further, if she wasn't breaking the law to begin with or engaging in an activity that could be construed as such, she wouldn't have been pulled. End of story. She put herself in this position

I am sorry I must have missed the part in the story where she plead guilty or there was a trial and she was convicted.
