It was illegal until last year. Reds have been fighting it tooth and nail based on "purity of marriage" for years. It's actually been illegal to be homosexual in certain states for years.
And it's an issue for people who want to get married and share their healthcare, hospital rights etc. This is big govt.

Adding additional departments to take on more oversight and control of the population is big government. Adding a law that makes certain acts illegal is not (necessarily) big government unless such laws need an expansion of bureaucracy to enforce them. Small government doesn't mean no government.
