No it would be the same time, he would have 5 years with the Chargers now. If he goes back in the draft a team that takes him will give him a 4 year deal. Essentially he becomes a FA at the same time. He will lose money but he and his family don't need the money. That is why I'm glad to see him take a stand against the Chargers.

All 1st round deals are 4 years with a 5th year option. That's not something that can be negotiated

I hate when people say this. My dad or grandfather being a millionaire is not the same as me being a millionaire. It's nice leverage to have, I suppose, but I'm sure just about everybody on earth would rather be independently wealthy. Handouts come with strings.
It sucks--and the Chargers are assholes--but he's got to sign. He'd never be able to recoup that money. He should sign, keep his head down, enjoy the shite out of San Diego, work his butt off, kick arse, and then sign a huge deal with the Broncos or Chiefs in 5 years and shove it up the Chargers' arse twice a season.

You're assuming he falls out of the 1st round entirely. What if he just falls in the 1st round?
Then he has a 4 year contract with a team 5th year option; same as he has with the Chargers just at a lower salary point for 4 years with less signing bonus.
Personally, I'd expect him to fall but not entirely out of the 1st round. Which results in his 2nd contract being in 6 years instead of 5 (or 5 instead of 4 if he isn't that good).
