Univ of Texas going after HS for use of logo

KOSSUTH – The long time Kossuth Aggies steer logo will slowly start to change.
The University of Texas sent the Alcorn School District a letter last week concerning the use of the logo.
The trademark request gave Kossuth High School 15 days to contact the Texas school to discuss concerns involving the logo. The university then asked Kossuth to stop using the steer logo, which is extremely similar to the college’s longhorn logo.
Kossuth has used the steer logo since the late 1990s, and although the local school replaced the burnt orange with maroon, it is still a very close depiction of University of Texas branding.
“The university has offered to give Kossuth time to phase out the use of the longhorn logo,” said Alcorn School District Attorney Arch Bullard. “As of right now, those negotiations are still in progress.”
Burnt Orange Nation, a University of Texas fan website, reported in May that the Kossuth school was committing “sacrilege” stating the school’s logo combined the maroon of Texas A&M Aggies and the steer logo of the University of Texas Longhorns.
“This is a big deal,” said KHS Principal Travis Smith. “But, it’s not anything Kossuth faculty, students, parents or fans should be upset about toward the university. The Texas Longhorns are protecting their logo and I understand why. It’s just something we are going to have overcome. It will be a hard change, but one we will work out.”
According to Bullard, the current Kossuth logo will be transitioning from the UT longhorn logo to another steer silhouette logo.

Shouldn't they be able to protect their trademark?

I agree completely, but if they are doing this to this school then they need to go after every single high school that uses that logo.

They can protect their trademark however they please. They can choose to shut down one school while not going after another if they want

Seems like 75% of high schools use the logo of a college or professional team.
They usually don't give a crap.
But UT is very pretentious so this story isn't surprising.

I feel like every state has a school using the G that the Packers and Georgia use

They are just being whiny little bitches because their precious logo is colored maroon. That's the only reason.
I could understand if it was a Texas HS but it's a Mississippi HS.

The Univ. of Missouri sent a cease and desist letter to my HS alma mater, which is an "M" with black and gold tiger mascot.
This is nothing extraordinary.

Georgia Tech let's my highschool use their yellow jacket logo for $1/year. Not like anyone is going to confuse this highschool with UT

They have done this in the past. Nothing new.
On the other hand, Bill Snyder lets any high school use the K-State powercat logo for $1 per year.

Wonder if a school like Georgia does this? Im sure their G logo gets used pretty often.
I bet if their HS team wasn't the Aggies UT wouldnt care.

Texas went after a school in the KC metro era, Gardener Edgerton, a few years ago as well.
Wisconsin has gone after people in the past also, as well as other schools. I like the GT & Snyder KSU approach.

They probably do. People have to understand, if you have something trademarked but don't actively defend that trademark it could be an avenue for someone to illegally use it based on the grounds that you didn't try to protect it in the past.
Like a poster said, sometimes they let them use it, especially when it follows a similar color scheme because it's not diminishing the brand.

Texas went after a San Diego high school a few years ago.
The story about it sheds some light on the reasoning.

You happy now, Husker? That 1-9 record for your beloved Mothershuckers against Texas in the Big 12 really chapped your arse, didn't it?

quote:
New Jersey sports and entertainment trademark attorney Anthony Caruso said universities do not have to pursue every infringement, but they also cannot appear to be selectively enforcing their claim.
quote:
Westemeier said the University of Texas has discussed licensing, but hasn’t pursued it because of potential issues with the National Collegiate Athletic Association, which could see a conflict in financial agreements between high schools and colleges may recruit players from the schools.

This used to be true.

If you don't vigorously protect your trademarks you lose the right to protect them in the future. Universities have really stepped up on protecting their marks in the last 15 years or so. I'm surprised it took UT this long. I believe most of these High Schools were hit about 10 years ago.
But there is so many, some not even close to where the University is located (For example, a school in MS I recall had a different colored Michigan helmet/Hattiesburg was notoriously LSU's logo just with HHS instead of LSU). It takes time for them to find them.

My old high school North Vermilion uses the Patriots logo. Also St. Thomas Moore in Lafayette uses Penn State's oval Nittnay Lion logo. Always wondered how were they allowed to do that
