According to the article developers are not required to make the Neo better in fps. Just that it cannot be slower than the normal version.
And I doubt the developer will care about making the Neo look good. Sony would be the one to gain from that not the developer.
So, I don't see that becoming an issue

True, so I wonder if Sony would offer incentive for developers to make the NEO version better. If so, capping the FPS would definitely be the easiest thing to do to differentiate.
